What are Digital Product Passport requirements?

DPP requirements depend on the product and the applicable legal instrument, not a universal field checklist. See what ESPR confirms, what product acts still decide, and how batteries differ.

Digital Product Passport requirements depend on the product and the applicable legal instrument, not a universal field checklist. Under the current ESPR framework, Annex III and Articles 9 to 11 describe the system that product-specific delegated acts use. They are not a mandatory field list for every product. Specified battery passports apply from 18 February 2027. Other duties follow their own acts and application dates.

Start with applicability, not a field list

Before copying any vendor checklist, identify the product in legal terms, whether it is placed on the EU market or put into service, the economic-operator role, and the legal instrument. Then read the current secondary measure, if any, for application date, data, carrier, access and registration.

  1. What product is it?
  2. Which legal instrument applies?
  3. Has a product-specific measure been adopted?
  4. What does that act require?
    • Data
    • Carrier
    • Access
    • Registration
    • Application date
  5. Assess operational readiness
  • Classify the product in legal terms, not marketing terms.
  • Confirm EU-market placement or putting into service.
  • Identify the economic-operator role.
  • Identify the instrument: ESPR delegated act, Batteries Regulation, CPR, toys, detergents, or another act.
  • Check whether a product-specific act has been adopted. Working Plan years are indicative.
  • Read application date, data, carrier, access and registration from that act.
  • Keep a visible not-yet-determined column for everything else.

What the ESPR framework confirms — and what it does not

These points apply where an ESPR delegated act requires a Digital Product Passport. They are not a reason to treat every product as in scope today. Annex III lists information categories that delegated acts may use. It is not a universal mandatory field catalogue.

  • Passport data must be accurate, complete and up to date.
  • A data carrier connects to a persistent unique product identifier.
  • Formats should support open, interoperable, machine-readable information and avoid vendor lock-in for the covered technical requirements.
  • Access can differ by actor and data type; it is not automatically all-public.
  • Delegated acts specify, for the covered group, data, carrier, layout, model versus batch versus item, actors, updating, availability period and exemptions where used.
  • After a delegated act, operators normally have at least 18 months before application, subject to ESPR Article 4(8) exceptions in the act itself.

Other enacted DPP regimes

Sectoral laws can create passports outside ESPR delegated acts. Their datasets, access maps and dates are not interchangeable with ESPR Annex III.

Confirmed requirement

Battery passport — 18 February 2027

Each LMT, EV, and industrial battery greater than 2 kWh placed on the market or put into service. Commission guidance of 21 August 2026 maps 71 data points and does not add legal duties.

Confirmed — do not conflate

QR on all batteries

Article 13(6) requires a QR on all batteries from the same date. Only the Article 77 categories use that QR to reach a battery passport.

Confirmed date; not yet operational

Toys — 1 August 2030

Regulation (EU) 2025/2509 is adopted and in force. The model-level DPP in Article 19 applies from 1 August 2030. Technical follow-on may still develop.

Confirmed date; not yet operational

Detergents — 23 September 2029

Regulation (EU) 2026/405 is adopted. Article 21 creates a model-level DPP for detergents and specified end-user surfactants. Article 37 applies that duty from 23 September 2029.

Awaiting delegated act

Construction products

The CPR provides for a construction DPP. System operation depends on the Article 75 delegated act and staged periods.

Do not overstate

PPWR and CRMA

PPWR creates digital labelling and carrier rules, not a general packaging DPP. CRMA magnet information uses a unique-identifier-linked carrier and sits in a DPP only where another law already requires that passport.

Who may hold responsibilities

Commission economic-operator guidance states that primary responsibility for creation and accuracy rests with operators placing the product on the Union market, and that manufacturers, importers, authorised representatives, distributors, dealers and fulfilment service providers may be involved depending on the product group and legislation. That is official guidance, not a substitute for the operator articles in the applicable regulation.

Non-EU manufacturers may face customer data requests even when the EU importer is the legal operator. That is often contract, not identical statutory positioning.

Common claims we do not support

  • All products need a DPP by 2030.
  • ESPR Annex III is the mandatory field list for every product.
  • Every battery needs a battery passport.
  • Registry go-live means your product must be registered today.
  • A QR generator, PDF or readiness score proves compliance.
  • GS1 or a named vendor is required by ESPR for every product.
  • Working Plan 2027 for textiles means textile DPPs are mandatory in 2027.
